Fixations and Rendez-vous, April 22, 2004 |
The Quebec Rental Board (Régie du logement) is soon to send a corrected decision to 104 gas heated tenants of MSInc who had refused the "Fixation 2002" terms. It should call for some +2.1%, as NITA projected long ago, while all other tenants should get around +0.4%.
Within one month from the date when a judgment is rendered, all arrears must be paid to MSInc, subject to no interest, nor penalty. MSInc is not required to issue an invoice. Arrears are calculated from the very first month of "Fixation 2002" (say, July 2002, for example, in the case of leases that renew annually on July 1st), up to and including the very last month for which rent was paid at the "old" level (probably April 2004). From then on, the higher figure becomes the new Base Rent, paid every month, until "Fixation 2003" is settled.
Should be heard in the Autumn of 2004, latest. NITA guesses increases of some 0.7% for gas heated MSInc tenants, and 1.5% for all others, if no major repairs.
Hearings around the Spring of 2005, earliest. NITA forecasts +3.4% for gas heated dwellings, and +1.7% for all others. In addition, the very few tenants subject to major repairs (that would have been paid by MSInc during calendar 2003) should add another 30 cents to $3 a month. MSInc are said to offer +3% to everyone, without any distinctions.
MSInc are rumoured to offer long-term renewals. NITA members may e-mail their Association for further details.
